§ 1 General Provisions

1. The controller of personal data and the entity providing the newsletter service is Agata Borowska, address: Bruzdowa 116s/4 02-991, Warszawa.
2. The newsletter service is free of charge and consists of receiving, by electronic means (to the provided e-mail address), marketing and commercial information as well as educational content related to artistic activity.
   Use of the newsletter requires having an active e-mail account and a device with internet access.

§ 2 Consent and Conclusion of the Agreement

1. Subscription to the newsletter is made by:
   a) entering an e-mail address in the subscription form on the website agataborowskaart.com,
   b) selecting the appropriate consent checkbox (voluntary).
2. In order to complete the subscription, the user confirms their e-mail address (so-called Double Opt-In – recommended).
3. The agreement for the provision of the newsletter service is concluded for an indefinite period at the moment of subscription confirmation.

§ 3 Personal Data Protection (GDPR)

1. The controller of personal data is the Service Provider (details in § 1).
2. Personal data (e-mail address) are processed solely for the purpose of sending the newsletter, based on consent (Article 6(1)(a) GDPR).
3. The data will be processed until the user unsubscribes from the newsletter (withdraws consent).
4. The user has the right to access their data, rectify them, erase them („right to be forgotten”), restrict processing, and lodge a complaint with the supervisory authority (UODO).
5. Data are not shared with third parties, except for providers of e-mail marketing tools (e.g., Mailchimp, FreshMail).

§ 4 Resignation (Unsubscription)

1. The user has the right to unsubscribe from the newsletter at any time by clicking the “unsubscribe” link located in the footer of each e-mail message.
2. Unsubscription results in the immediate removal of the e-mail address from the subscribers’ database.

§ 5 Final Provisions

1. The controller reserves the right to amend these terms and conditions, informing users by e-mail at least 14 days in advance.
2. These terms and conditions enter into force on 01/03/2026.
